The Stables – Participant Waiver and Release of Liability
In consideration of being permitted to participate in any way at The Stables and in related events and activities, including but not limited to ice skating, I, the undersigned, acknowledge, appreciate, and agree as follows:
1. Acknowledgment of Risk
I understand that participation in ice skating and related activities involves inherent risks, including but not limited to slips, falls, collisions, and other incidents that may result in serious injury, permanent disability, or death. I acknowledge that while safety rules, equipment, and personal discipline may reduce these risks, the potential for serious injury still exists.
2. Assumption of Risk
I knowingly and voluntarily assume all such risks, both known and unknown, associated with participation in ice skating and related activities at The Stables, even if arising from the negligence of the “Releasees” or others. I accept full responsibility for my participation and for any injury, loss, or damage that may occur as a result.
3. Compliance with Rules
I agree to comply with all stated and customary terms, rules, and conditions for participation. If I observe any unusual hazard or unsafe condition during my presence or participation, I will immediately remove myself from participation and bring such condition to the attention of a staff member or official.
4. Release and Indemnification
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby RELEASE, INDEMNIFY, AND HOLD HARMLESS The Stables, its officers, officials, agents, employees, volunteers, sponsors, partners, and property owners (“Releasees”) from any and all claims, demands, losses, or liabilities for injury, disability, death, or damage to person or property, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.
Rental Equipment Agreement and Assumption of Risk
By renting skates or other equipment from The Stables, I agree to the following:
Assumption of Equipment Risk
I acknowledge that using ice skates and related equipment carries inherent risks, including the potential for personal injury or death. I freely assume and accept all such risks, known and unknown, arising from the use of this equipment. I also acknowledge that these risks can be reduced by taking lessons, following The Stables’ Responsibility Code, and exercising common sense.
Release and Waiver of Claims
In consideration of being provided or renting skating equipment, I agree as follows:
Acceptance of Equipment “As Is” – I accept full responsibility for the equipment as issued and agree to return it in the same condition.
Waiver of Claims – I waive any and all claims I have or may have in the future against The Stables arising out of my use of the equipment.
Release from Liability – I release The Stables from any and all liability for loss, damage, injury, or expense suffered by me or my next of kin as a result of my use of the equipment, regardless of cause, including negligence or breach of warranty related to design, selection, maintenance, or adjustment.
Binding Effect
This Agreement shall be binding upon my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
